POCATELLO, Idaho (KLIX)-A southern Idaho doctor will spend less than a year behind bars for selling some of his patients mis-branded breast implants.

The U.S. Attorney Bart Davis said 55-year-old Dr. Temp Patterson, formerly of Burley has been sentenced to seven months in prison on charges of receipt and delivery of misbranded devices. Dr. Patterson will also serve a year of supervised release after getting out of prison and will be required to pay $8,200 in restitution and a $10,000 fine.

The doctor had sold and implanted nine pairs of misbranded breast implants to patients between March 2014 and April 2015; the implants had not been approved by the Food and Drug Administration and came from China.

Patterson provided patients with information making it seem as if the implants they were getting had been FDA approved. In one instance Patterson altered labeling on the implants and changed medical records to falsely claiming they had been the correct and approved implants.

Members of the community trust their medical providers to use FDA-approved products,” said U.S. Attorney Davis in a prepared statemetn. “Doctors who choose to mislead their patients and use unapproved products will be prosecuted. I commend the efforts of the FDA Office of Criminal Investigations for their work.
