TWIN FALLS, Idaho (KMVT)-A Twin Falls man was charged with lewd conduct with a minor under the age of 16 Monday following an investigation that started last August. Jacob Edward Morgan, 19, was arraigned in court on Monday. His preliminary hearing is set for April 1 at the Twin Falls County Courthouse. Bond is set at $100,000.

On Aug. 10 at about 1:12 p.m., police responded to O’Leary Middle School regarding a juvenile female reporting she had been sexually assaulted. Two days prior the victim and a friend had allegedly been hanging out behind Dick’s Pharmacy in Twin Falls with Morgan.

Court documents reported, the victim’s friend had heard a commotion in front of the pharmacy and went to investigate. During this time, the victim was sitting on the ground in front of Morgan when oral sex was initiated and the victim tried to stop him. Morgan fled the scene, when the victim’s father arrived.

The officer took photos of text messages exchanged between the alleged victim and Morgan from Aug. 5-8. Morgan had allegedly said he was 17 years old in text messages and the alleged victim said she was 15. Officers made attempts to locate Morgan, but were unsuccessful.

In January, the victim’s friends positively identified Morgan from a driver’s license photo, as the person they’d been with behind Dick’s Pharmacy. Morgan came into the Twin Falls Police Department on March 15 to be interviewed on another case in which Morgan was eventually charged with rape, read more on that case here. During the interview, Morgan was questioned about the August incident.

He said he and the alleged victim has kissed each other behind Dick’s Pharmacy, then the alleged victim initiate oral sex. Soon after the encounter the victim’s father arrived and he fled. A warrant for his arrest was filed on March 18. Morgan was also arrested on charges of rape on March 15. He is currently booked at the Twin Falls County Jail.
