TWIN FALLS, Idaho (AP) — A trial date has been set for a Rupert man charged with shooting his brother to death in south-central Idaho in February 2012.

The Times-News reports (http://bit.ly/S1Oh4M ) District Judge Randy Stoker scheduled 34-year-old Damon Azure's trial to start on Sept. 8.

Azure is charged with first-degree murder in the shooting death of 31-year-old Seanachen Azure. Prosecutors say he was shot in the head, mouth and torso at a park near Kimberly.

In March 2012, Damon Azure was found to be dangerously mentally ill and not fit to proceed with the case. After spending 90 days in the competency restoration unit at the Idaho Maximum Security Institution, and a judge said he was fit to proceed.

Defense attorneys have unsuccessfully tried to overturn Idaho's ban on the use of an insanity defense in criminal cases.
