The Denmark-based developer has purchased the former studios of the Duke while an earth-shattering lawsuit is on its way.

Polygon reported that Interceptor Entertainment bought out 3D Realms and spin-off studio, Apogee Software, Ltd (named for the original alias 3D Realms had in the 1980s). Interceptor and 3D Realms are both currently undergoing a lawsuit against Gearbox Software.

Gearbox is suing both developers based on the premise that 3D Realms and Interceptor have been illegally using the Duke Nukem property for the upcoming Duke Nukem: Mass Destruction title despite Gearbox buying the rights to the franchise in 2010.

Unfortunately, this acquisition by Interceptor doesn't necessarily mean that Duke Nukem: Mass Destruction is in the clear. Most likely, this studio acquisition was made in order to help consolidate the properties of both studios in order and help organize a means of legally acquiring the rights and finances to continue production on Mass Destruction.
