Idaho Murder Case of Missing Woman Postponed

MOSCOW, Idaho (AP) — The first-degree murder trial of 52-year-old Charles A. Capone, which was scheduled to start with jury selection on Monday, has been postponed.

Latah County Prosecutor Bill Thompson Jr. tells the Lewiston Tribune that 2nd District Judge Michael J. Griffin is planning to recuse himself from the trial. Thompson says Griffin indicated there was an unforeseen circumstance that happened over the weekend that caused the delay.

A new trial date hasn’t been set. Capone, of Moscow, is charged with killing his estranged wife, 40-year-old Rachael Anderson, in April 2010. Charging documents allege her body was thrown into the Snake River, but it has not been recovered. Capone has pleaded not guilty to murder and failure to notify a coroner or law enforcement about a death.
