RIGBY, Idaho (AP) — A former Jefferson County sheriff has asked that his conviction for misuse of funds be overturned. Blair Olsen filed two motions with the 7th District Court on Monday, asking that he be acquitted or given a new trial.

Olsen was convicted May 13 of three counts of felony misuse of public funds after prosecutors said he used county money to pay for his wife's cellphone from 2010 to 2012. A fourth charge alleging that Olsen used county money to buy a lifetime membership in the National Rifle Association was previously dismissed.

In his motions, Olsen contends that the state didn't have jurisdiction in the case and that some jurors fell asleep during the trial that was held in Twin Falls. Judge Gregory Moeller will likely make a decision on the motion before Olsen is scheduled to be sentenced on June 22. He faces up to 33 years in prison.
