Boise police have released more information regarding a Twin Falls County Magistrate Judge who was recently cited by that department on a charge of excessive DUI.  The Times News reports that Judge Nicole Cannon was pulled over by Boise police in April after a police officer noticed her vehicle had crossed over the fog line at least twice.  Police say Cannon took a breathalyzer test and the results showed .239 for the first test and a .221 for the second.  Idaho’s legal limit to drive is .08.  Cannon was cited for excessive DUI and released.  As her case continues in the court system records indicate that as many as eight different judges have recused themselves from hearing her case.  Cannon, a former Minidoka County prosecutor,  has been serving as Magistrate Judge since January 2011.  The maximum sentence for excessive DUI in Idaho is a year in jail, a minimum one year driver’s license suspension and a $2000 fine.
